Information about Land Use Planning

The Department of Land Use Planning  is responsible for comprehensive land use planning for Umatilla County. Information, assistance and regulatory permits can be obtained from this department.  The type of permits that are processed are burning permits, conditional use permits, comprehensive plan changes, zoning and development permits, and rural addressing. This department also houses the Code Enforcement Office. The following are printable copies of various information and permits (requires Adobe Acrobat Reader):

Umatilla County has been working through the initial steps to possibly re-establish the minimum parcel size in the EFU-10, EFU-20 and EFU-40 Zones.  These zones are still shown on the zoning maps, but the minimum parcel was changed to 80 acres or greater in 1993 as a result of a law enacted by the Oregon Legislature (HB 3661).  A number of meetings were held this past summer with Bruce Sorte, OSU Community Economist, where he presented his report on the economics of farming small parcels in Umatilla County.  His report concluded that small farm operations or “Adaptive Farming” can be economically viable.  You can obtain a copy of the complete report at below.

What to do next…

The next step is to formulate detailed information in preparation of a “Go-Below” application and begin the public hearing process.  However, before the County devotes more time and resources to this effort, we would like your input.  Please review the information included in this HANDOUT, complete the SURVEY (PDF) print it and send it back to the County Planning Department by Friday, February 26, 2010.  You can also complete the survey online by visiting the Online Planning Survey (survey results will be posted to the same site and will be presented to the Planning Commission).  If you have questions call County Planning at 541-278-6249.

The table below outlines certain land use actions that may or may not be possible if the minimum parcel size for the EFU-10, EFU-20 and EFU-40 Zones were to be re-established.

Parcels zoned EFU-10 – A parcel 20 acres or larger can be divided into 10 acre parcels.

Parcels zoned EFU-20 – A parcel 40 acres or larger can be divided into 20 acre parcels.

Parcels zoned EFU-40 – A parcel 80 acres or larger can be divided into 40 acre parcels.

 

Dwellings - New dwellings are not automatically allowed on new parcels created.  Certain levels of gross farm income would be required to establish a home on a small parcel


Boundary Line Adjustments - The flexibility of boundary line adjustments will be affected between parcels in these zones.  For example, a parcel in the EFU-10 zone could not be adjusted below 10 acres in size.

Land Use Request Application, complete this form for ALL types of land use applications.  Select the Supplemental Application below for the specific type of land use application desired.

Zoning Permit Application  A zoning permit is applied for if the use is permitted outright on the subject property and only requiring a zoning permit or after a land use permit application is obtained and a zoning permit is required.  Attach the appropriate fee as stated on the form, complete site plan and all signatures of the property owners of the subject property.  

Boundary Line Adjustment, an application for modifying a boundary line between two parcels.

Farm ExemptFarm Agriculture/Equine Building Exemption.  State law (ORS 455.315) allows exemption from the requirements for a building permit and inspections under the Oregon State Structural Specialty Code for certain agricultural buildings.  A landowner must obtain approval and signature from the local planning office to qualify for this type of permit. Farm Exempt structures are only allowed on resource zoned land (EFU and GF) where a bona fide "farm" is being operated.  The property must be assessed under the "Farm Deferral" tax program.

Complete both the State BCD's Farm Agriculture/Equine Building Exemption application and the County's Zoning Permit application.

Notice of Appeal Application, complete when appealing a County Planning Commission decision.

Request for a Public Hearing Application, complete when asking for a public hearing during an administrative review of a land use permit application.

Rural Addressing/Road Naming Application, complete this form when naming a roadway if required during a land division request or when a third dwelling is placed on a lane or roadway and the roadway is required to be named.

STATE PERMITS, visit these sites to find the permit application and process for these state permits.

An authorized Sanitary Septic System with a  Land Use Compatibility Statement (LUCS) from the Department of Environmental Quality for construction of a new septic system or repair to a failing system. An Authorization Notice is needed if you are re-connecting to an existing system or changing the waste flow by increasing the occupancy of a house or building.

A Building Permit from the State Building Codes Agency for: all additions, new structures, certain remodels, setup of manufactured homes, and plumbing, electrical, and mechanical permits.

Supplemental Applications

Complete the Land Use Request Application as well as the Supplemental Application that fits the type of permit you are requesting. 

Amendments to County Plan/Development Code and/or Zoning Map, an application for requesting changes in the County's Comprehensive Plan, Development Code and/or Zoning Map.

Conditional Use Permit, an application for a variety of uses (i.e. home occupation, hardship dwelling, etc.) that may be applied for where certain conditions of approval will be applied.

Land Division, an application for dividing a lot or parcel.  There are a number of different types of land divisions - Type I - Subdivision, Type II - Partition of Non Resource land (rural residential, etc.), Type III - Replat and Type IV - Partition of Resource land (EFU and GF).

Land Use Decision, an application for dwellings and other similar uses

Variance, to request a modification from the required standards (i.e. setbacks, parcel size, etc.)

Zoning Maps are available by visiting GIS and Zoning Maps.  You will need to know the Township, Range, Section and Tax Lot of the parcel.  The maps are divided into Township and Range folders and are simple PDF files.

Natural Hazards Mitigation Plan 2009

"Umatilla County Natural Hazards Mitigation Plan 2009 (PDF)  The Natural Hazards Plan for the County has been reviewed by FEMA and the County Board of Commissioners adopted the Plan on June 30, 2009.  The Plan outlines general policies when dealing with natural hazards (flood, earthquake, severe winter storm, etc.)  in Umatilla County.
