You ARE HEREBY NOTIFIED of a Public Hearing to be held before the Umatilla County Planning Commission on Thursday, April 26, 2012 at 6:30 PM at the Media Room of the County Justice Center, 4700 NW Pioneer Place, Pendleton, OR 97801.  CONTINUED TO SEPT. 27, 2012.

Comprehensive Plan Amendment, #T-11-044, Applicant is Umatilla County.     County proposes to amend the Comprehensive Plan to allow the creation of parcels less than 80 acres in size in the existing Exclusive Farm Use -10, -20 and -40 acre zones.  The application is subject to go-below standards found in Oregon Administrative Rule 660-033-0100 and Section 152.751 of the Umatilla County Development Code.

The table below outlines certain land uses that may or may not be possible if the minimum parcel sizes for the EFU-10, EFU-20 or the EFU-40 zones were to be re-established.

What MAY be Possible if  Re-establishing  the minimum parcel size for the EFU-10, EFU-20 and EFU-40 Zones

What MAY NOT be Possible if  Re-establishing  the minimum parcel size for the EFU-10, EFU-20 and EFU-40 Zones

Parcels zoned EFU-10 - A parcel 20 acres or larger could be divided into two  parcels each being at least 10 acres in size.

Dwellings - New dwellings are not automatically allowed on new parcels created.  Current dwelling standards would be applicable.

Parcels zoned EFU-20 - A parcel 40 acres or larger could be divided into two  parcels each being at least 20 acres in size.  

Boundary Line Adjustments - The flexibility of boundary line adjustments will be affected between parcels in these zones.  For example, a parcel in the EFU-10 zone could not be adjusted below 10 acres in size.

Parcels zoned EFU-40 - A parcel 80 acres or larger could be divided into two  parcels each being at least 40 acres in size.

WKN CHOPIN  TRANSMISSION LINE PROJECT

The  Board of Commissioners held a Public Click for WKN Project MapHearing for the WKN Transmission Line, #LUD-138-11 APPEAL on February 13, 2012 at 9:30 AM, Umatilla County Justice Center, Media Room, 4700 Pioneer Place, Pendleton, Oregon.   The Board upheld the decision of the Planning Commission and denied the Appeal.  An appeal was filed with the Land Use Board of Appeals (LUBA) on the matter.

HATLEY V. UMATILLA COUNTY, LUBA No. 2012-017 and 2012-018

The LUBA Appeal No. 2012-017 and 2012-018 is in response to the REMAND of the COSNER V. UMATILLA COUNTY, LUBA No. 2011-070, 071 and 072.

COSNER V. UMATILLA COUNTY, LUBA No. 2011-070, 071 and 072

The recently adopted County Ordinance 2011-05, 2011-06 and 2011-07 implementing the Development Code update for Section 152.616 (HHH) Commercial Wind Generation Siting criteria was appealed to the Land Use Board of Appeals. COSNER V. UMATILLA COUNTY, LUBA No. 2011-070, 071 & 072 are the file numbers associated with each of the three local ordinances.  Below is the entire record submitted by the County to LUBA.  The record was divided into 8 volumes which consisted of some 4,442 pages.


REMAND Proposal.  Posted February 21, 2012 detailing the options for the Board of Commissioners to address the LUBA Remand of Ordinance 2011-05, 2011-06 and 2011-07.

LUBA OPINION  The Land Use Board of Appeals sent out their opinion on the Cosner v. Umatilla County appeal.  (posted January 18, 2012)  Some issues were REMANDED to the County and will be addressed in the near future with hearings to be announced
