CONCEALED HANDGUN LICENSES

The following information is a general guideline regarding the procedures and requirements for becoming a concealed handgun license holder in Umatilla County. Oregon laws governing the issuance and denial of concealed handgun licenses may be found in Chapter 166 of the Oregon Revised Statutes which are available at public libraries, the law library in the County Courthouse and on the internet.  Click here to download a Concealed Handgun Permit Application.

Eligibility Requirements:

  • An applicant must be a citizen of the United States or a legal resident alien with documentation of continuous residency for at least six months and proof of written declaration to the Immigration and Naturalization Service of the intent to become a citizen. • Must be at least 21 years old.
  • Must have their principal residence in Umatilla County. This may be waived for residents of bordering states with a compelling business interest or legitimate demonstrated need.
  • No outstanding warrants for arrest. 
  • Cannot be free on any form of pre-trial release. 
  • Must demonstrate competence with a handgun by any one of the following:
    • 1. Completion of any firearms training course involving handgun safety offered by the NRA, law enforcement, community college, private organization or firearms training school conducted by a firearms instructor certified by the NRA or a law enforcement agency.
    • 2. Documentation of equivalent experience with a handgun through participation in organized shooting competition or military service.
    • 3. Previously licensed to carry a firearm in Oregon, unless the license has been revoked. 
  • No felony convictions. (ORS 161.295 includes exception for guilty by insanity.)
  • No misdemeanor convictions within four years prior to application. (ORS 161.295 includes exception for guilty by insanity.)
  • Has not been committed to Mental Health and Developmental Disability Services Division under ORS 426.130.
  • Has never been found mentally ill or subject to an order under ORS 426.130 prohibiting purchase or possession of a firearm.
  • Has been discharged from the jurisdiction of the juvenile court for more than four years if, while a minor, was under their jurisdiction for having committed an act which, if committed by an adult, would constitute a felony or misdemeanor involving violence as defined by ORS 166.470.
  • Is not subject to a stalking order under ORS 30.866, 163.735, 163.738 or a restraining order to prevent abuse issued under ORS 107.700 to 107.732. An applicant who has been granted relief under ORS 166.274 or 166.293 or 18 U.S.C. 925[c] or whose record has been expunged under state law or equivalent laws of other jurisdictions is eligible providing other criteria is met.

FEDERAL PROHIBITIONS:

Federal law 18 U.S.C. § 922(g) in brief, prohibits possession of any firearm or ammunition by anyone who:

  • Has been convicted of a crime punishable by imprisonment for a term exceeding one year.
  • Who has been discharged from the Armed Forces under dishonorable conditions.
  • Who is subject to a court order restraining the person from harassing, stalking or threatening an intimate partner or child of an intimate partner after a hearing in which the person had an opportunity to participate which finds that the person represents a credible threat or prohibits the use, attempted use or threatened use of physical force that would reasonably be expected to cause bodily injury.
  • Who has been convicted in any court of a misdemeanor crime of domestic violence.

THE APPLICATION MAY BE DENIED IF:

The application may be denied if there is reasonable cause to believe applicant has been or is likely to be a danger to self or others, or to the community, as a result of the applicant's mental or psychological state, as demonstrated by past pattern of behavior or participation in incidents involving unlawful violence or threats of unlawful violence. These conditions include but are not limited to:

  • A history of confrontation with others, including neighbors, family members, etc.
  • A history of conflict with law enforcement officers.
  • Offenses involving firearms.
  • Documented problems involving alcohol and/or drug abuse.

If any of the preceding apply, appropriate documentation and explanation of circumstances may be submitted to the Sheriff for consideration.

HANDGUN SAFETY TRAINING:

Before an application for a concealed handgun license can be accepted, you must show completion of handgun safety training You may meet this requirement by providing any one of the following:

  • A certificate of completion of any firearms training course involving handgun safety offered by the NRA, law enforcement, community college, private organization or firearms training school conducted by a firearms instructor certified by the NRA or a law enforcement agency. The certificate must declare that the training included handgun safety and the credentials of the instructor in order to meet this requirement.
  • Documentation of equivalent experience with a handgun through participation in organized shooting competition or military service. Military documentation such as a DD214 must specifically cite training with a handgun.
  • Previously licensed to carry a firearm in Oregon, unless the license has been revoked.

OUT OF STATE RESIDENTS:

Individuals living in states which border the State of Oregon may apply for a concealed handgun license. A written request describing a business interest or other demonstrated need for the license in Umatilla County must be submitted with the application. Issuance of a license to a non-resident applicant is at the discretion of the sheriff..

PROCEDURE:

Applications are taken by appointment only. At the time the application is submitted, the applicant is photographed and the fee collected. New applicants are fingerprinted. Two pieces of identification are required; one must be a valid driver's license or ID card with correct physical address.

The applicant may be required to provide written documentation to substantiate any statements made on the application.

The fee is
$65.00 for new applicants and $50.00 for renewals.

The fee for duplication of license due to address change, loss or transfer is $15.00. State law requires that your current address appear on your license. This law also requires a $15.00 fee for change of address. Failure to change your address is cause for revocation.

If you move to another county within Oregon, contact the Sheriff's Office there to have the license transferred. If move to a state which borders the State of Oregon and wish to retain your license, contact this office for more information.

The fee is non-refundable. Checks should be made payable to "Umatilla County Sheriff".

BACKGROUND INVESTIGATION:

State and Federal law enforcement records, Department of Motor Vehicles and Department of Human Services records are checked. Additional law enforcement agencies may be also be contacted.

Additional investigation may be required as determined by the Sheriff or his staff.

ISSUANCE RENEWAL:

Upon successful completion of the application process, the license is mailed to the address provided on the application. The license is valid within the State of Oregon and must be carried whenever a concealed handgun is carried.

The license is valid for four years. It may be renewed if applied for prior to the expiration date. The renewal procedure is the same as that for new applicants, however, fingerprints are not required. Should your license expire, you cannot carry a concealed handgun until you have again completed the application process and been issued a new license.

 The license remains the property of the Sheriff.

PLACES CONCEALED HANDGUN LICENSE HOLDERS MAY NOT CARRY A FIREARM:

  • Any federal facility, including past the security checkpoint in airports, Federal courthouse, Post Office, Social Security Office, Recruiting Offices and in designated areas of federal lands including National Parks, Ranger Stations or Visitors Centers, game refuges and wildlife preserves.
  • Court facilities (defined as a courthouse or that portion of any building occupied by the court, personnel related to the operations of the courts or in which activities take place related to the operations of the courts).
  • Designated Recreation Areas on State forest lands.
  • Any private business or facility which prohibits possession of firearms.
  • The carrying of firearms is generally prohibited on reservations except with the permission of the tribal council. This also applies to certain casinos operated by tribes. Contact the Tribal Police for more information.

If found with a weapon on these premises, the concealed handgun license will be seized and returned to the Sheriff, and the holder may be subject to criminal and/or civil penalties.
