Commissioner Hansell called the meeting to order at 1:30 p.m.

 

 

CONTINUED HEARING:

 

REMAND - VARIANCE #V-291-06 AND LAND PARTITION #LD-5N-714-06: Powerline Ranch, LLC Applicant and Owner.  Property is Tax Lot 400 of Assessor’s Map 5N 35 and is located east of Lower Dry Creek road.   The property is zoned Exclusive Farm Use (EFU).

 

THE PROPOSED REQUEST is to partition the property into two parcels of 80 acres and 93.25 acres pursuant to UCDC Type IV, Review II, Level I land divisions.

 

REMAND - VARIANCE #V-292-06 AND LAND PARTITION #LD-5N-715-06:  Vineyard Group LLC Applicant and Owner.  Property is tax lot 401 of Assessor’s Map 5N 35 and is located east of Lower Dry Creek Road. The property is zoned Exclusive Farm Use (EFU).

 

THE PROPOSED REQUEST is to partition the property into two parcels of 90.53 acres and 80.02 acres pursuant to UCDC Type IV, Review II, Level I land divisions.

 

REMAND - VARIANCE #V-294-06 AND LAND PARTITION #LD-5N-717-06:  High Ridge Properties, Applicant and Owner.  Property is tax lot 802 of Assessor’s Map 5N 35 and is located on the west side of Lower Dry Creek road and south of Seven Hills Road.   The property is zoned Exclusive Farm Use (EFU).

 

THE PROPOSED REQUEST is to partition the 359.80 acre parcel into three parcels, of 80.5 acres, 161 acres and 132.20 acres pursuant to UCDC Type IV, Review II, Level I land divisions.

 

REMAND - VARIANCE #V-295-06 AND LAND PARTITION #LD-5N-718-06:  North Slope Management, LLC, Applicant and Owner.  Property is tax lot 803 of Assessor’s Map 5N 35 and is located west of Lower Dry Creek Road and south of Seven Hills Road. The property is zoned Exclusive Farm Use (EFU).

 

THE PROPOSED REQUEST is to partition the 231.64 acre parcel into two parcels of 83.8 and 147.9 acres in size pursuant to UCDC Type IV, Review II, Level I land divisions.

 

Criteria of approval for the proposed partitions and variance requests can be found in Sections 152.710 (B) (3) of the Umatilla County Development Code and the remand decision of the Land Use Board of Appeals.  

 

Request for Continuance:  County Counsel, Doug Olsen explained that this hearing was a continuance of the hearing of April 22, 2008.  It was continued to this date at the request of the appellant, Friends of Umatilla County, to allow them time to review the applicants’ materials and submit additional evidence. 

 

Evidence received from Friends of Umatilla County on April 29, 2008 raised issues with the circular area review (CAR) analysis.  On May 6, 2008 the applicant submitted new information regarding the CAR analysis in response to the appellant’s materials. 

 

The appellant has requested that deliberation and decision be delayed to allow time to review the new materials submitted by the applicant, and the applicant is in agreement.  They request two additional weeks for appellant review and response, and one week after that for the applicants’ final rebuttal. 

 

Planning Director, Tamra Mabbott asked if the new hearing date would involve testimony or would be only for deliberation.  Mr. Olsen replied that it would be for deliberation and decision only.

 

Commissioner Hansell stated that he would be agreeable with granting the appellant’s request. 

 

Mr. Olsen explained that the appellant would have until 5:00 p.m. on Thursday, May 22, 2008 to submit further argument.  The applicant would then have until 5:00 p.m. Thursday, May 29, 2008 for final rebuttal, and the record would then be closed.  Mr. Olsen suggested scheduling deliberation and decision for Tuesday, June 3, 2008.  There was discussion about the date. 

 

Commissioner Hansell called for a motion to continue the hearing to Monday, June 2, 2008 at 11:00 a.m., keeping the record open to the appellant until 5:00 p.m., May 22, 2008 and 5:00 p.m., May 29, 2008 for the applicant.  The record will then be closed to all parties.  Commissioner Givens made the motion.  Commissioner Doherty seconded.  Motion carried unanimously.
